1. Provisions in Article 2, Paragraph 3, and Article 4 of the Property Law: The phone is your legitimate personal property, and you own it; no individual or organization (except law enforcement agencies) has the right to possess or withhold it.

2. Articles 34 and 35 of the Property Law: You have the right to request restoration and return of property from any individual or organization (except law enforcement agencies) that infringes on your lawful property.

3. If the school has rules prohibiting students from bringing phones to school but has no rules allowing teachers to confiscate them, according to the Property Law, no one can infringe on someone else's personal property. Moreover, the school has no right to confiscate, even if it is a public school. The school can only be a school and can never be a law enforcement body. If certain schools rule that teachers can confiscate, this rule conflicts with the law and is therefore illegal and should typically be abolished.

4. The Teacher Law does not grant teachers the power to 'confiscate or withhold students' property.' Furthermore, the Laws on the Protection of Minors, Teacher Law, and Education Law all state that students' legal rights must not be violated. The rights in the Property Law are considered legal rights.

In other words, this means that by confiscating your phone, the teacher not only violates the Property Law but also infringes upon the student's legal rights. You can not only get your phone back but also sue the teacher in court for these four offenses.
